AURORA<\/strong> | City council on Monday unanimously approved the creation of an Office of Public Safety Accountability, a permanent monitoring office to oversee police, fire, 911 and detention.<\/p>\n

The office\u2019s duties will include investigating critical public safety incidents that result in serious injury or death, as well as ongoing reviews of public safety operations. It also will share information with the public, provide liaisons to impacted families and conduct community engagement.<\/p>\n

Creation of the office follows years of efforts to improve accountability and transparency in police and fire departments after the death of Elijah McClain in 2019, which, among other cases, prompted state investigators to find a pattern of racial bias and excessive use of force.<\/p>\n

Since 2022, the city police reform efforts have been reviewed by a contracted monitor, which has released periodic progress reports about training and policy updates. The April report found that police and fire departments are substantially compliant with the consent decree\u2019s mandates.\u00a0<\/p>\n

The report also identified the need for the city to implement an independent monitoring system to sustain the changes and progress.<\/p>\n

At Monday\u2019s meeting, community members were mostly supportive of the new office, but some did raise some criticisms.<\/p>\n

Cassandra Heil, from the Denver Aurora Community Action Committee, called the office \u201ca band-aid on an infection,\u201d and said she opposes it because of its inability to enforce change or consequences on the departments it oversees. Heil added that community involvement should be more central to the office.<\/p>\n

\u201c(The office) can document problems, write reports and make recommendations, but it cannot stop police misconduct from actually happening,\u201d Heil said. \u201cIf neither the community nor the office has the power to create change, then this bill cannot actually deliver accountability.\u201d<\/p>\n

MiDian Shofner, founder of the Epitome of Black Excellence and Partnership, said the office has some strong provisions, like the notification requirement and family liaison, but was concerned about the lack of authority and that there isn\u2019t enough community engagement.<\/p>\n

The ordinance establishing the office requires at least two community engagement sessions each year. It also requires the office to notify families of a critical incident within 48 hours and assign a liaison.\u00a0<\/p>\n

\u201cIf we\u2019re not invited in to collaborate intentionally and thoughtfully and to curate what this community is truly asking you, not conceptually, but practically, I\u2019m not sure we\u2019re going to have an accountability system. We\u2019re just going to have a spectator system,\u201d Shofner said.<\/p>\n

There were also comments in support of the accountability office as a step in the right direction. Aaron Futrell said the office\u2019s ability to provide independent oversight and share information with the community \u201cis exactly the type of accountability that healthy institutions embrace.\u201d<\/p>\n

\u201cAurora has a chance to demonstrate that we\u2019ve learned from our past and that we are serious about building a future where transparency, accountability, and public trust are not just points, but guiding principles,\u201d he said.<\/p>\n

While conservative council members had previously questioned what protections the ordinance will have to keep politics from influencing the office, council members unanimously supported the ordinance on Monday.<\/p>\n

Councilmember Gianina Horton said creating a public safety accountability office helps bring Aurora more in line with other cities, like Denver and Fort Worth.<\/p>\n

\u201cObviously, as was shared, we still have a long way to go and there\u2019s really no end goal beyond the vision that we have a police department that is effective in their job without the loss of life,\u201d Horton said.\u00a0<\/p>\n

The ordinance establishing the Office of Public Safety Accountability says its mission will be \u201cthe furtherance of the reforms achieved under the Consent Decree and culture of continuous improvement.\u201d<\/p>\n

The office will be overseen by a manager, who will be hired by the city manager and report administratively to the city manager\u2019s office, while providing information to the city council\u2019s public safety committee.\u00a0<\/p>\n

In addition to investigating critical incidents, the office will review and report on all public safety functions on an ongoing basis, including \u201cuse of force reviews, policy development, and department operations and performance meetings.\u201d It will also release annual reports on its findings, as well as take complaints and commendations.<\/p>\n

The office will work in conjunction with the city\u2019s internal auditor and the Civil Service Commission, which oversees hiring, promotions and discipline for police and fire employees.\u00a0<\/p>\n

Under the ordinance, the office would get \u201cunrestricted access\u201d to city employees, information, police records and electronic data, body-worn camera videos, property, equipment and facilities required for the office to conduct reviews and oversight.\u00a0<\/p>\n

City Manager Jason Batchelor said the office is modeled after the city\u2019s internal auditor and designed to be independent and have unfettered access to information, though he clarified that requests for information would need a specific reason and couldn\u2019t be used for \u201cfishing expeditions.\u201d<\/p>\n

City Attorney Pete Schulte said the city chose to model the office after the internal auditor because the city\u2019s charter restricts boards and commissions, made up of appointed residents, to advisory roles without the ability to enforce change or access all the necessary information.\u00a0\u00a0<\/p>\n

Batchelor said the city has budgeted for two full-time positions in the office for 2026.<\/p>\n

Council will vote one more time to finalize the ordinance and establish the office.\u00a0<\/p>\n
